IMPORTANT: All plumbing fixtures should be installed by a licensed plumber or contractor.

Items that are not installed as such may void any warranties by the product’s manufacturer. 
 

Payment:
Full payment is is required to initiate an order. All orders must be paid in full at the time product becomes available for shipment or pickup. A service charge of the lesser of 2% per month or the maximum permissible rate will be added to all accounts not paid within seven (7) calendar days from the date product is ready to be shipped or picked up. Purchaser and/or Agent must pay, or reimburse Faucets Galore of Nevada, LLC for, all charges for transportation and delivery and all excise, order, occupation, use, sales or similar taxes, levies, charges or surcharges with respect to an order. All orders must be paid in full, including shipping, handling, packing, storage, taxes and service charges, prior to any release for shipment to Purchaser and/or Agent.

 

General Disclaimer:
Faucets Galore of Nevada, LLC disclaims all expressed or implied warranties, including all implied warranties of merchantability or fitness for a particular purpose or application. In no event will Faucets Galore be liable for any incidental, punitive, special or consequential damages arising directly or indirectly from the installation, operation, or use of any products sold by Faucets Galore. Faucets Galore's liability, if any, must be limited to the Purchaser’s net sales price of the item at the time of purchase. Faucets Galore is not responsible for any delays or lack of product availability. Product availability and shipping time estimates are subject to change and cannot be guaranteed. Projects which are awarded assume all parties will work together to develop a mutually agreeable construction and material schedule. Please allow enough time when planning out your overall project, and consider enough time for the material ordering process. Bids are solely based on the information provided to Faucets Galore by you and/or your contractors. All quotation or Sales Order revisions are subject to price review, which may result in increased costs to you. Faucets Galore reserves the right to withdraw any bids at any time, and pricing may change if a quotation is not accepted and converted to an order, and a minimum deposit is made within (30) thirty days from quotation date. All written or verbal pricing is subject to change without notice.

Shipping:
At the time of order, all shipping is estimated and based on each item's size, weight, shipping method and delivery address. Actual shipping costs may vary. Occasionally a shipping quotation is not available, and as such the costs cannot be determined until delivery. Shipping estimates are based on locations within the continental US. Please contact a sales representative for shipping outside the continental US. Drop-ship fees may be imposed on the Purchaser if Faucets Galore is charged for such a fee.

Expedited Shipping:
Expedited shipments carry an additional charge. For in-stock merchandise in the Faucets Galore Las Vegas facility, items generally ship the same business day for expedited orders received by 1PM PST. For in-stock merchandise from any other location, items generally ship the same business day for expedited orders received by 11AM PST. Deliveries are generally not available on Saturdays or Sundays.

Sales Tax:
Faucets Galore collects and pays sales tax for all orders shipped, delivered, or picked up within Nevada. We generally do not charge sales tax on orders outside Nevada, unless Nexus rules apply. If you have a valid Nevada State Sales & Use Permit, please provide a copy to your sales representative for authorization to waive any applicable Sales Tax. Please see a representative for any applicable sales tax exemptions or sales tax permit questions.

Merchandise Pickup:
Faucets Galore will compile and retain merchandise ordered on behalf of a client for a maximum of thirty (30) days after receipt of merchandise into Faucets Galore’s facility, or from date of order, if merchandise is available at time of order. All merchandise must be picked up within that timeframe. Merchandise not picked up within that timeframe will be re-collected and resold without further notice to the Purchaser and any/all deposits and payments will be forfeited by the Purchaser. If Purchaser breaches, or attempts to cancel this Agreement for any reason, or if Faucets Galore cancels this Agreement because of Purchaser's failure to make any payment when due, or because of Purchaser's refusal to take delivery, Faucets Galore, may retain all payment made before such breach attempted or cancellation, as liquidated damages, in addition to all rights and remedies available to Faucets Galore, for breach of this Agreement. Purchaser has 10 days to rectify the situation with final payment, and after that, has no further force or affect.

Cancellations:
Not all items are cancellable or changeable. See your representative for details on specific items. Some items or orders may be cancelled for a full refund, provided the item(s) has not left the manufacturer’s or Faucets Galore’s facility. Our sales staff will provide order status and whether or not a particular order or item can be cancelled. Once an item has shipped by the manufacturer or has left our facility, the terms of our Return Policy take effect.

Damaged Materials:
Do not sign for or accept any products that are visibly damaged. If a product appears to be damaged, refuse the item at the time of shipment and notify our sales department immediately to have a replacement item ordered or issued. Once merchandise is accepted by the Purchaser, it is assumed to be without visible defects and cannot be returned if visible defect(s) later are identified. Any operational defects must be handled directly through the manufacturer’s warranty program, if applicable.

 

Product Warranties:

In addition to all other provisions within this Agreement, Faucets Galore of Nevada, LLC does NOT warrant ANY merchandise. All warranty related concerns must be directed to the product's manufacturer.

Returns & Exchanges:
Returnable, uninstalled, non-defective item(s) can be returned or exchanged for a refund within thirty (30) days of purchase date, but will be subject to a restocking fee of typically 25%, but can range from 20% up to 50% of the purchase price. Shipping charges and other fees are not refundable. Items must be in the original packaging, and complete with all components in order to be eligible for return or exchange. The following items are considered NON-RETURNABLE and cannot be cancelled, returned, or exchanged: items considered Final Sale, Clearance, Specials, Accessories, Parts, or items deemed non-returnable by the manufacturer.

 

Availability:
Neither Faucets Galore of Nevada, LLC nor Manufacturer must be liable for any delays in, inability to complete, or other default in any order for any reason or cause beyond Faucets Galore of Nevada, LLC's or Manufacturer's reasonable control, including but not limited to (a) government action, war, riots, civil commotion, embargoes or martial laws, (b) Faucets Galore or Manufacturer's inability to obtain necessary materials from its usual sources of supply, (c) shortage of labor, raw material, production or transportation facilities or other delays in transit, (d) labor difficulty involving Faucets Galore, Manufacturer or others, (e) fire, flood or other casualty, or (f) other contingencies of manufacture or shipment. In the event of any delay in Faucets Galore's or Manufacturer's performance due, in whole or in part, to any cause beyond Faucets Galore's or Manufacturer's reasonable control, Faucets Galore and Manufacturer must have such additional time for performance as may be reasonably necessary under the circumstances. Purchaser's and/or Agent's acceptance of any merchandise must constitute a waiver by Purchaser and/or Agent of any claim for damages on account of any delay in delivery of such merchandise.

 

Method of Shipment:
Manufacturer will determine product shipment methods and carriers unless otherwise agreed by all parties. Any shipments returned to Manufacturer or Faucets Galore, including but not limited to such returns as a result of Purchaser's and/or Agent's improper failure to accept delivery or otherwise accept the merchandise, will require Purchaser and/or Agent to pay all additional costs incurred by Manufacturer and/or Faucets Galore of Nevada, LLC, including but not limited to shipping and storage fees.

 

Warranty:
Many manufacturers provide warranties for their products. Please inquire with your products’ Manufacturer for their specific warranty details. Warranties do not apply to damage, misuse, accidents, abuse, neglect, mishandling, or wear resulting from normal use. Merchandise determined to be defective will be replaced within the normal time period required to reorder the same product.

 

Remedies Upon Default:
In addition to the General Disclaimer, If Purchaser and/or Agent fails to make payment in accordance with the terms herein or otherwise fails to comply with any provision hereof, Faucets Galore may, at its option, cancel any unshipped portion of an order, retain the merchandise and declare a forfeiture of the deposit as liquidated damages. Faucets Galore also (in addition to other remedies available) has the right to appropriate and sell the merchandise and apply the amounts collected to any payment due Faucets Galore, Manufacturer and/or the payment of any expenses and costs to exercise Faucets Galore’s rights hereunder, as Faucets Galore determines in its sole discretion. Purchaser and/or Agent will remain liable for the balance of all unpaid accounts.

 

Drawings, Plans, Dimensions, Samples
All drawings, descriptions, dimensions, and illustrations provided by Faucets Galore or Manufacturer, including in any price lists, catalogs or advertisements, are close approximations only. Any examples or samples exhibited or provided to Purchaser and/or Agent are for general informational purposes only. Nothing in any drawings, descriptions, illustrations, lists, advertisements, catalogs or samples must be deemed to create a representation or warranty or serve as the basis for any claim against Faucets Galore or Manufacturer. In addition, some items may be handmade, or specially treated or processed, and are subject to slight variations, which Purchaser and/or Agent acknowledge and agree to.

 

Waiver:
Waiver by Faucets Galore of Nevada, LLC or Manufacturer of any breach of these terms and conditions must not be construed as a waiver of any other breach, and failure to exercise any right arising from any default hereunder must not be deemed a waiver of such right which may be exercised at any subsequent time.

 

Severability:
In the event that any one or more of these terms or conditions is held invalid, illegal or unenforceable, such provision or provisions must be severed and the remaining terms and conditions must remain binding and effective.

 

Complete Agreement: The terms and conditions contained within this Agreement represent the complete agreement of the Undersigned Purchaser and/or its Agent, and Faucets Galore of Nevada, LLC, and no terms or conditions in any way adding to, modifying or otherwise changing the provisions stated herein are binding upon Faucets Galore unless made in writing, and signed by an Authorized Agent of Faucets Galore of Nevada, LLC. No modification of any of these terms will be effected by Purchaser's purchase order, shipping request or similar forms containing terms and conditions conflicting or inconsistent with the terms herein.

 

Governing Law:
This agreement and all rights and obligations hereunder must be governed by the laws of the State of Nevada including but not limited to the Uniform Commercial Code as enacted in that jurisdiction, without giving effect to the principles of conflicts of law thereof. All disputes must be filed with the American Arbitration Association (AAA) in Nevada and governed by the rules of the AAA. All decisions made in the arbitration must be binding and an entry of judgment must be deemed to the prevailing party. Any judgment rendered by the arbitrator may be entered in any court having jurisdiction. Attorney fees and related costs must be awarded to the prevailing party.
